Hosting Uptime Guarantee

CoreCloudConnect / XOOMMIT offers a monthly Uptime Guarantee (“Guarantee”) for the Hosted Services You purchase from Us.

All Shared hosting plans are covered by a 99.99% monthly Guarantee.


Limitation

Any service interruption resulting from failure or deficiency in CoreCloudConnect / XOOMMIT’s infrastructure or equipment may not be eligible for remedy if caused by or related to factors including, but not limited to:

  • DDoS or similar attacks on Our servers;
  • Third-party software failure;
  • You exceeding the resource limits of Your account;
  • Issues arising from Your own errors or omissions;
  • Interruptions caused by custom scripting, coding, or installation of third-party applications by You;
  • Network conditions across the internet, outside of our network, such as those between Your ISP and Our data center;
  • Firewall blocks or bans;
  • Browser or DNS caching issues;
  • Outages related to the reliability of specific programming environments;
  • Any other circumstances beyond Our control or not reasonably foreseeable;
  • Acts of God or force majeure leading to service failure.

All remedies will be at the sole discretion of CoreCloudConnect / XOOMMIT, based on the results of Our investigation into any issue covered by this section.

If CoreCloudConnect / XOOMMIT provides a remedy or Guarantee for a particular service, this will be Your sole and exclusive remedy for defects or issues with that service. CoreCloudConnect / XOOMMIT will not be liable for any consequential or indirect loss or damage caused by the failure of the service.


Amendment

CoreCloudConnect / XOOMMIT may amend or modify the terms of this Guarantee at any time by providing notice on the CoreCloudConnect / XOOMMIT website.
