Hosting Terms of Service

These Terms of Service (the “Agreement”) outline the terms and conditions of Your use of hosting and related services (“Services”). In this Agreement, “You” and “Your” refer to You as the user of Our Services, or any agent, employee, servant, or person authorized to act on Your behalf. “We,” “Us,” and “Our” refer to CoreCloudConnect / XOOMMIT, Inc., as well as its subsidiaries and sister companies.

This Agreement is in addition to CoreCloudConnect / XOOMMIT’s Universal Terms of Service and other applicable terms, including but not limited to the following policies: Acceptable Use Policy, Limitation of Liability, Indemnification, and Trademark + Copyright Policies.

Term of Agreement; Modification

You agree that CoreCloudConnect / XOOMMIT may modify this Agreement and the Services it offers to You from time to time. You agree to be bound by any reasonable changes CoreCloudConnect / XOOMMIT may make to this Agreement when such changes occur. If You have purchased Services from CoreCloudConnect / XOOMMIT, the terms and conditions of this Agreement will remain in full effect as long as You continue to use the Services. By continuing to use the Services after any revisions to this Agreement or changes to the Services, You agree to abide by and be bound by such revisions or changes.

Privacy

Your Personal Information + Use of Hosting Services. CoreCloudConnect / XOOMMIT’s Privacy Policy, which is incorporated herein by reference, applies to all Services. The Privacy Policy outlines Your rights and CoreCloudConnect / XOOMMIT’s responsibilities with respect to the personal information collected from You as a customer.

Hosting Service + Your Personal Information. Some third-party products or services included in CoreCloudConnect / XOOMMIT’s offerings may collect and process additional personal information about You as part of their operations. CoreCloudConnect / XOOMMIT collects minimal additional information when You use these Services. This includes information to create logs that document Your actions in relation to the use of these Services, with the typical personal information collected being Your IP address. All personal information collected and processed by CoreCloudConnect / XOOMMIT will only be used in accordance with its intended purposes.

Third Party Personal Information You Collect + Process. You represent and warrant that You have provided notice to, and obtained consent from, any third-party individuals whose personal data You collect and provide to CoreCloudConnect / XOOMMIT as part of the Services. This includes ensuring they are aware of:

(i) the purposes for which such third party’s personal data has been collected;

(ii) the intended recipients or categories of recipients of the third party’s personal data;

(iii) which parts of the third party’s data are obligatory and which parts, if any, are voluntary; and

(iv) how the third party can access and, if necessary, rectify the data held about them.

You further agree to provide such notice and obtain such consent with regard to any third-party personal data You supply to CoreCloudConnect / XOOMMIT in the future. CoreCloudConnect / XOOMMIT is not responsible for any consequences arising from Your failure to provide notice or obtain appropriate consent from these individuals, nor for providing outdated, incomplete, or inaccurate data.

Third Party Personal Information Collected + Processed Via Service. Information about third-party visitors to Your website may be collected and processed when You use Our Service. Below are details of when and how this may occur.

CoreCloudConnect / XOOMMIT Does Not Collect Website Visitor Personal Information. CoreCloudConnect / XOOMMIT does not collect any personal data from visitors to Your site. We solely operate as a processor, retaining information that You collect as part of Your hosted content, at Your direction.

Third-Party Tools + Visitor Personal Information You May Collect. Our Services include several third-party tools integrated to enhance Your experience. These include:

  • LiteSpeed. LiteSpeed is used to optimize hosted content and balance server load. It does not collect personal information about Your site visitors. For more information, see the LiteSpeed Privacy Policy.
  • cPanel. cPanel is the interface that provides You control over Your site. Several cPanel features may collect visitor personal information, such as cPanel Analytics. By default, these features are turned off in Shared Hosting. You control whether to use them. cPanel also offers features like email services. If You decide to use these features, You are acting as the data controller, and cPanel operates as a data processor. Acceptable Use Policy

CoreCloudConnect / XOOMMIT’s Acceptable Use Policy (“AUP”), which is incorporated herein by reference, applies to all hosting Services, including email services provided within such hosting Services. You agree to use all Services for lawful purposes only and to maintain Your website in full compliance with the AUP.

IP Address

CoreCloudConnect / XOOMMIT assigns an Internet Protocol (“IP”) address to You for use with its services. The right to use that IP address remains with CoreCloudConnect / XOOMMIT, and You may only use it as permitted by CoreCloudConnect / XOOMMIT at its sole discretion. CoreCloudConnect / XOOMMIT reserves the right to change the IP address assigned to Your services at any time for any reason.

Technical Subdomain

As part of the Hosting service, CoreCloudConnect / XOOMMIT provides all Shared Hosting accounts with a technical subdomain, set as the main domain of the cPanel account by default, for purely technical purposes. It cannot be removed or used with web tools, custom websites, email, SSL certificates, or other services.

Storage and Security

You bear full responsibility for the security and protection of Your hosted content and server data. You are solely responsible for maintaining the confidentiality of Your password and account information and for all actions taken with Your account. It is Your responsibility to:

(i) Prevent any loss or damage to Your server content; (ii) Maintain independent backups of Your server content; (iii) Ensure the security and confidentiality of Your server content transmitted or stored on CoreCloudConnect / XOOMMIT servers; and (iv) Keep Your password confidential.

CoreCloudConnect / XOOMMIT’s services are not intended for use as backup or archival storage. Using an account for storing electronic files may result in termination of hosting services. We reserve the right to delete archives that impact overall server performance and will not be liable for loss or destruction of Your content. Our services do not provide PCI (Payment Card Industry) compliance.

AutoBackup

AutoBackup is an optional service available to Essential, Pro, and Supreme hosting plans. It stores multiple versions of Your website files and databases, including 6 daily, 4 weekly, and 1 monthly backup. Backups are securely stored offsite and have a storage limit of 5GB. Accounts exceeding 100GB will be excluded from AutoBackup, and backup services will not impact Your hosting disk space.

AutoBackup is non-refundable and requires an enabled auto-renewal option. If auto-renewal fails due to a declined credit card, the AutoBackup will be suspended.

Secure Shell (“SSH”) Access

You may enable SSH access for Your account. If misused, access will be revoked, and attempts to circumvent this policy will result in immediate account termination.

Non-Exclusive Right to Use

CoreCloudConnect / XOOMMIT grants You a limited, non-exclusive, non-transferable right to use its software. You may not modify, reverse engineer, or combine it with other software. CoreCloudConnect / XOOMMIT reserves all rights to the software, which remains its intellectual property.

Third-Party Software

CoreCloudConnect / XOOMMIT provides third-party software, including but not limited to cPanel, CloudLinux, Softaculous, and LiteSpeed. These are provided on an “as-is” basis, and CoreCloudConnect / XOOMMIT does not guarantee results or functionality. You agree to the terms of each third-party provider.

Third-Party Content

If You host third-party content on Your site, You are responsible for ensuring compliance with the Acceptable Use Policy. Failure to respond to violations may result in service termination.

Billing and Payment

All fees are based on CoreCloudConnect / XOOMMIT’s current fee schedule. Services renew automatically unless You disable auto-renew. Failure to pay renewal fees may result in immediate suspension of services.

Termination and Cancellation Policy

Your agreement with CoreCloudConnect / XOOMMIT automatically renews unless You or CoreCloudConnect / XOOMMIT terminate the agreement. CoreCloudConnect / XOOMMIT reserves the right to terminate services without prior notice if You violate terms or cause unreasonable demands on Our services.

Transfer of Content

Upon termination of services, You are responsible for transferring Your content from CoreCloudConnect / XOOMMIT’s servers. CoreCloudConnect / XOOMMIT does not provide backup or transfer services.

Customer Support

CoreCloudConnect / XOOMMIT offers customer support for its hosting services. You are responsible for backing up Your data before requesting support. If You provide login credentials, We recommend using temporary credentials.

Legal Purposes

CoreCloudConnect / XOOMMIT’s hosting services must be used for legal purposes in compliance with applicable laws. We reserve the right to refuse service for illegal, offensive, or misleading content.

Trademark or Copyright Claims

CoreCloudConnect / XOOMMIT respects intellectual property rights and may terminate accounts for repeated copyright infringement. For details, see Our Trademark and Copyright policies.
